6. Intellectual Property
CaseOrbit AI and its original content, features, and functionality are and will remain the exclusive property of Junes Legal Services, Inc. You retain all rights to the data and content you upload to the platform. You grant us a limited license to host, store, and process your content solely to provide the service.

8. Data and Backups
We maintain regular backups of platform data. However, you are responsible for maintaining your own copies of important data. We are not liable for data loss resulting from your actions, third-party service failures, or force majeure events.
9. Disclaimer of Warranties
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JUNES LEGAL SERVICES, INC. SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.
11. Termination
We may suspend or terminate your account for material breach of these Terms, non-payment, or illegal activity, with or without prior notice depending on severity. Upon termination, your right to access the platform ceases immediately. Data export requests must be submitted within 90 days of termination.
12. Governing Law
These Terms shall be governed by the laws of the State of New York, without regard to its conflict of law provisions. Disputes shall be resolved by binding arbitration in New York County, NY, except that either party may seek injunctive relief in any court of competent jurisdiction.
13. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated with at least 30 days' advance notice via email and in-platform notification. Your continued use after the effective date constitutes acceptance of the revised Terms.
14. Indemnification
Each party will defend the other against the third-party claims described in this section. We will defend you against a claim that the Platform, used as these Terms permit, infringes a third party's intellectual property rights, and will pay damages finally awarded or agreed in settlement of such a claim. You will defend us against a claim arising from material you place on the Platform, or from use of the Platform in breach of these Terms or of law that applies to you. Neither obligation applies to the extent a claim arises from the other party's modification of the Platform, its combination with anything we did not supply, or its continued use after we have asked in writing that it stop. A party seeking indemnity must notify the other promptly in writing, allow it to control the defence, and give reasonable cooperation at the indemnifying party's expense; no settlement admitting fault or imposing an obligation on the indemnified party may be agreed without that party's consent, which will not be unreasonably withheld.
15. Privileged Material, Work Product and Compelled Disclosure
Material you place on the Platform may be subject to legal professional privilege, the attorney-client privilege, litigation privilege, professional secrecy or work-product protection, or to equivalent protections under the law and professional rules that apply to you. You and your clients retain all rights in that material; we claim none. We access it only as necessary to provide, secure and support the Platform, through personnel bound by confidentiality obligations, and we record such access. We do not use your material to train machine-learning models, to develop other products, or for any purpose other than providing the Platform to you. If we receive a subpoena, court order, warrant or other demand for your material, we will notify you before disclosing anything unless law forbids us to, give you a reasonable opportunity to object or seek protective relief, and assert any applicable privilege on your behalf until you are able to assert it yourself. Nothing in these Terms waives any privilege or protection attaching to your material, and our holding it as your service provider is not intended to create, and does not create, any such waiver.
16. Export and Return of Client Files
You may export your data at any time during your subscription, in a machine-readable format, without charge and without having to ask us. The files you and your clients place on the Platform belong to you and to them: we assert no lien or other security interest over them, and we will not withhold them on account of a billing dispute or for any other reason. After your subscription ends we will keep your data available for export for at least ninety (90) days. We will delete it within thirty (30) days after that period ends, or earlier if you ask us in writing, except where law requires us to retain it; residual copies in routine backups are purged within a further thirty (30) days. We will confirm deletion in writing if you ask.
17. Your Professional Obligations
You remain responsible for your own professional and ethical duties, including those concerning client confidentiality, conflicts of interest, competence, supervision, record-keeping, and the safekeeping of client property and funds. The Platform is a tool that supports those duties; it does not discharge them. Nothing the Platform produces automatically — including any date, limitation period, calculation, document or other draft it generates or suggests — is legal advice, and none of it is a substitute for your professional judgment: you are responsible for reviewing and verifying anything you rely on. Where the bar, law society, regulator or court rules that apply to you impose requirements on the use of third-party or cloud technology — such as informing clients, obtaining consent, or satisfying yourself about data location or security — meeting those requirements is yours. We will give you the information about the Platform that you reasonably need in order to do so.
